These Terms of Service ("Terms") govern your access to and use of ChipMonk Poker (the "Service"), available at chipmonk.fun. By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

ChipMonk Poker is a free, browser-based Texas Hold'em poker game played with virtual chips that have no real-world value and cannot be exchanged for money, prizes, or anything of value. The Service is provided for entertainment purposes only and is not gambling. No purchase is necessary to play.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is greater) to use the Service. By using the Service you represent that you meet this requirement.

3. Virtual chips

Virtual chips are a game mechanic only. They have no monetary value and cannot be redeemed, transferred, sold, or cashed out.
We may grant, adjust, or remove virtual chips at any time for any reason, including to correct bugs or to address abuse.
Loss of virtual chips, including loss caused by software bugs, browser data clearing, or termination of the Service, does not entitle you to any compensation.

4. Acceptable use

You agree not to:

Use bots, scripts, or automation to play on your behalf or to manipulate game outcomes
Attempt to reverse-engineer, hack, or interfere with the Service
Bypass advertising or rewarded-video safeguards
Use the Service in any manner that violates applicable law
Misrepresent the Service as being affiliated with any third party

5. Advertising

The Service is ad-supported. By using the Service you acknowledge that advertisements will be displayed and that we and our advertising partners may use cookies and similar technologies as described in our Privacy Policy.

6. Intellectual property

All content, software, design, and trademarks associated with the Service are owned by ChipMonk Poker or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written consent.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CHIPMONK POKER OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED FIVE U.S. DOLLARS (USD $5.00).

9. Indemnification

You agree to indemnify and hold harmless ChipMonk Poker from any claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time.

11. Changes to the Service or Terms

We may modify or discontinue the Service or these Terms at any time. Material changes to these Terms will be reflected by an updated date at the top. Continued use after changes constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in the United States, and you consent to that jurisdiction.
